1. Welcome to Foundable

These Terms are an agreement between you and Autono Labs, Inc., a Delaware corporation (“Foundable,” “we,” “us”), which runs Foundable (the “Service”). By creating an account or using Foundable, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy. Where Foundable handles personal information for you, such as your website visitors’ details, our Data Processing Addendum is part of these Terms too, with no signature needed. If you use Foundable for a company, you confirm you can agree for it, and “you” means that company.

These Terms, and the policies they include, apply to accounts created on or after October 30, 2026 from that day, and to accounts created before then from November 30, 2026. Until then, the earlier version applies to those accounts.

PLEASE READ SECTION 17. IT SAYS THAT MOST DISPUTES BETWEEN US WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT OR IN A CLASS ACTION, AND EXPLAINS HOW YOU CAN OPT OUT.

2. What Foundable does

Foundable gives you Ted, an AI assistant that builds, publishes and runs websites and helps with your business’s work, such as posts, email and selling. Ted runs on AI models from third-party providers, which can change over time. Ted is software, not a person. Our AI Disclosure explains what he can and can’t do.

3. Your account

You’re responsible for what happens in your account and for keeping it secure. You agree to:

  • Be at least 16 years old, or older where the law requires.
  • Give us accurate information and keep it up to date.
  • Not share your account. Invite each teammate as their own user.
  • Tell us right away at security@foundable.com if you think your account or a connected service has been compromised.
  • Use Foundable only where it’s available, without a VPN or other workaround, and not if you’re in a country under comprehensive US sanctions or on a US government restricted-parties list. You’ll follow US and other export laws that apply to you.

4. Using Foundable responsibly

You agree to follow our Acceptable Use Policy, which is part of these Terms, and the laws that apply to you and your business. We may limit, suspend or close an account that breaks it, with or without notice depending on how serious the problem is.

5. Your content

You own what you put into Foundable and what Ted makes for you (“your content,” or “Customer Content”), to the extent the law allows. You give us a worldwide, non-exclusive, royalty-free permission to host, store, copy, send, display and process your content only as needed to run and improve Foundable for you, including sending it to our service providers and to the apps you connect. We don’t train AI models on your content, and we don’t sell it.

You confirm you have the rights and consents needed for your content and that using it with Foundable doesn’t break the law or anyone’s rights.

6. Apps you connect and work Ted does for you

When you connect another service, such as a social account, email, calendar, your phone, or a Stripe account, you let Foundable access it and act in it the way you approved. Those services are run by other companies under their own terms, and we aren’t responsible for them.

You’re responsible for what Ted does for you in those services, such as publishing a post, sending an email, answering a call or charging a customer. Ted acts only within the permissions and settings you choose. When an owner or admin lets him, he can send, change or delete things in a connected service without asking again for each step; he follows requests to keep work as a draft, settings that require approval, and instructions to stop. You can pause him or disconnect a service at any time, and stop texts by texting STOP. Something already done in another service can only be undone with that service’s own tools. How we handle what Ted reads from Google and Microsoft apps is in section 12 of our Privacy Policy.

Campaigns managed by Foundable

When you approve a campaign, you authorize Foundable to act as your agent to create, run and measure it within the total you approved, including the fee shown. You confirm that you can act for the business being promoted and authorize us to share its campaign information and permitted website events with Meta. You agree to Meta’s Terms of Service, Commercial Terms, Self-Serve Ad Terms, Advertising Standards and Business Tools Terms, and authorize us to accept them for that business.

Campaigns use Foundable’s managed account and Page. The campaign must accurately identify the business, product or service being promoted. Your campaign’s budget, results and data are used for your business; we don’t combine customers’ audiences. Meta decides whether to accept and deliver a campaign, and results aren’t guaranteed.

Participating websites ask visitors before sharing visits with Meta. You are responsible for an accurate privacy notice and the rights and permissions needed to share that data. Don’t use this feature on a website directed to children under 13, or where a visit reveals sensitive information, such as a person’s health or financial circumstances. Don’t remove or bypass visitors’ privacy choices. You can stop a campaign in Run; a stop doesn’t undo spending already incurred.

Selling with Foundable Payments

When you turn on payments, Foundable sets up a Stripe account for your business and sends you to Stripe to add your details. That account is yours, under Stripe’s Connected Account Agreement. You are the seller of everything you sell. We aren’t the seller and take no fee; Stripe charges its own. Refunds, disputes, payouts, receipts and taxes on your sales are yours to handle in Stripe. Subscriptions you sell renew until canceled, and your customers can manage or cancel them through a link on your website. What you sell must follow Stripe’s Restricted Businesses list and our Acceptable Use Policy.

Listing on Google

Ted lists your products on Google only after you agree to Google’s Merchant Center terms. Google decides whether to show them.

Domains

Domains you buy through Foundable are covered by our Domain Holding Agreement.

7. AI output

Ted’s work is created by AI. It can be wrong, out of date or unsuitable for what you need, and it can resemble what Ted makes for other people. Review it before you publish, send or rely on it, especially for important decisions. Foundable doesn’t give legal, medical, financial or other professional advice.

8. Plans, credits and payment

Some of Foundable is free; the rest needs a paid plan or credits. The price and billing cycle are shown before you pay, and tax is added where it applies.

  • Who charges you. Our plans and credit packs are sold through Link, a Stripe service that is the seller of record. Link charges your payment method, collects any tax and emails your receipts, and your statement shows LINK.COM* FOUNDABLE. At checkout you also accept Link’s terms.
  • Renewal. Plans renew automatically each month or year until you cancel. Cancel at any time in Settings → Plans & credit usage → Manage billing, or at link.com; your plan stays active until the end of the period you paid for.
  • Price changes. We’ll notify you before a new price applies to your plan (where California law applies, 7 to 30 days before), and you can cancel before it does. Where the law requires your consent, we’ll ask for it.
  • Refunds. Payments aren’t refundable except as our Refund & Dispute Policy (part of these Terms), Link’s refund policy or the law provides.
  • Currency and availability. Prices are in US dollars, and checkout may offer your local currency. Paid plans aren’t available in every country.
  • Taxes and fees. You’re responsible for taxes the law requires you to pay that aren’t collected at checkout, and for your own bank or mobile-carrier fees.
  • Late payment. If a payment fails, we may downgrade, suspend or close the account.

Credits

Credits pay for work in Foundable. They have no cash value, can’t be transferred or used outside Foundable, and your balance and spending are shown in Settings → Plans & credit usage.

  • Plan credits arrive each month. On the Pro and Max plans, unused credits carry over for one more month and then expire; on other plans, they expire when the next month’s credits arrive. Annual plans are paid upfront and give credits monthly on the same rule, and their credits expire no later than 30 days after the year ends.
  • Credit packs are one-time purchases. Their credits expire 12 months after purchase unless the pack was offered as never expiring, and stay yours if your plan ends. Credits that expire sooner are used first.
  • Changing plans. A move to a bigger plan or to annual billing starts right away at the new plan’s price, and you keep your current credits. A move to a smaller plan or to monthly billing starts at the end of your billing period.
  • Daily credits. We may give eligible accounts a small daily allowance, which doesn’t build up.
  • Refunds and disputes. If a payment is fully refunded or reversed, we remove the unused credits it bought.

Referral credits

You can invite people from Settings → Earn credits. When someone new joins through your link and makes their first payment for a paid plan, you each earn referral credits, yours up to the daily limit shown there. Each referral must be a real person who is new to Foundable, not you or an account made to collect credits. We decide whether a referral counts, may remove credits earned unfairly or from a refunded payment, and may change or end the program at any time, without taking back credits fairly earned.

9. Preview features

Features marked “preview,” “beta” or “experimental” are offered as they are, may change or go away without notice, and may not work as expected.

10. Our property

Foundable, including its software, design and the Foundable and Ted names and logos, belongs to us. We give you a personal, limited permission to use it under these Terms. You may not copy or take apart our software, use Foundable to build a competing product or train a competing AI model, remove our notices, or resell access without our written agreement.

If you send us feedback or ideas, we may use them freely.

12. Disclaimer

FOUNDABLE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T PROMISE THAT FOUNDABLE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI OUTPUT WILL BE ACCURATE, OR THAT FOUNDABLE WILL MEET YOUR NEEDS OR BRING YOUR BUSINESS ANY PARTICULAR RESULT.

Some places don’t allow these exclusions, so parts of this section may not apply to you.

13. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THESE TERMS OR FOUNDABLE WON’T BE MORE THAN THE GREATER OF (A) WHAT YOU PAID US FOR FOUNDABLE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) US$100.

These limits apply whatever the legal theory. Some places don’t allow them, so parts of this section may not apply to you.

14. Claims against us caused by you

If someone makes a claim against us because of your content, your website or business, work you had Ted do for you in a connected service, or your breaking these Terms or the law, you’ll defend us and cover our reasonable costs, including lawyers’ fees, and any resulting damages. We’ll tell you about the claim promptly and work with you on it.

15. Ending your use of Foundable

You can stop using Foundable and delete your account at any time, as our Data Deletion Instructions describe.

We may suspend or close your account if you break these Terms, if you create legal or security risk for us or others, or if we stop offering Foundable. We’ll give you reasonable notice when we can, but may act right away for serious problems such as fraud or harm to others. Sections that by their nature should continue after your account ends, including 5 and 10 to 18, will continue.

16. Changes to these Terms

We may update these Terms as Foundable changes, and the date at the top shows the latest version. If we make a material change, we’ll tell you in advance by email or in Foundable. If you keep using Foundable after the change takes effect, you accept it; if you don’t agree, stop using Foundable and delete your account.

17. Resolving disputes

Talk to us first.

Most problems can be solved quickly. Before starting a formal dispute, email legal@foundable.com with your name, your account email and a description of the problem and what you want. We’ll both try in good faith to resolve it within 60 days.

Arbitration.

If we can’t resolve it, you and we agree that any dispute about these Terms or Foundable will be decided by binding individual arbitration, not in court, except as this section says. The American Arbitration Association (AAA) will run it under its Consumer Arbitration Rules where they apply, and its Commercial Arbitration Rules otherwise. The arbitrator can award the same individual relief a court could, and fees follow the AAA’s rules. A hearing can be held by video or phone, or near where you live. The Federal Arbitration Act governs this section.

Exceptions.

Either of us may bring an individual claim in small claims court, and either of us may ask a court to stop someone from misusing intellectual property. A request for public injunctive relief will be decided by a court after the rest of the dispute is arbitrated.

NO CLASS ACTIONS. YOU AND WE MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION, AND YOU AND WE GIVE UP ANY RIGHT TO A JURY TRIAL.

You can opt out.

You can opt out of arbitration within 30 days of first agreeing to these Terms, or, if you had an account before this section was added, within 30 days of when we notify you of it, by emailing legal@foundable.com from your account email with the subject “Arbitration opt-out.” Opting out doesn’t affect anything else in these Terms.

Courts and law.

Delaware law governs these Terms, apart from its conflict-of-law rules, and the UN Convention on Contracts for the International Sale of Goods doesn’t apply. Any dispute that isn’t arbitrated will be decided only in the state or federal courts in New Castle County, Delaware, and you and we agree to their jurisdiction. If the no-class-action rule is found unenforceable for a claim, that claim will go to court, not arbitration. Nothing here takes away rights the law where you live gives you and doesn’t allow you to give up, and this section doesn’t apply to a claim already filed before it took effect.

18. Other terms

These Terms, with the policies they include, are the whole agreement between you and us about Foundable. If part of them can’t be enforced, the rest still applies. If we don’t enforce a right, we haven’t given it up. You can’t transfer these Terms without our written consent; we may transfer them as part of a merger, acquisition or sale of assets. Neither of us is responsible for delays, other than in paying what is owed, caused by events beyond our reasonable control, such as natural disasters, war, or outages of internet or cloud providers. If you use Foundable for a US government entity, it’s provided as a “commercial item” under these Terms. A separate signed agreement with a business customer takes priority over these Terms where they conflict.

We may send you notices by email, in Foundable or on our website. Send legal notices to legal@foundable.com or Autono Labs, Inc., 131 Continental Drive, Suite 305, Newark, DE 19713, USA.
